Distilling beverage alcohol is regulated and may be illegal without government authorization—even when it is done at home, for personal use, or in small quantities.
In Canada, producing spirits generally requires appropriate federal authorization from the Canada Revenue Agency under the Excise Act, 2001. Provincial or territorial manufacturer, alcohol, zoning, fire-safety, environmental, and municipal approvals may also be required. Excise duties, reporting obligations, recordkeeping rules, inspections, and product-labelling requirements may apply.
Purchasing or owning equipment does not automatically authorize anyone to manufacture beverage alcohol.
Before fermenting for distillation, assembling or operating the machine, or producing any beverage spirit, customers must:
- Determine which laws apply in their jurisdiction.
- Obtain every required federal, provincial, territorial, and municipal licence or approval.
- Complete and submit all required government paperwork.
- Pay all applicable duties, taxes, fees, and assessments.
- Follow applicable safety, recordkeeping, labelling, storage, and reporting requirements.
Government licences, permits, registrations, approvals, tax accounts, duty payments, and paperwork are not included.
